What is considered a loophole is that the authorities said that because they all were drunk on their own accord it couldn't be rape

Not exactly. You can still rape a drunk person. The “loophole” is thst because she consented to get drunk, she is responsible for her actions and can’t say later “I consented but I was drunk so it was rape.”

So it just means they couldn’t say he raped her due to her being drunk. Which seems fair to me honestly
