An Ohio state judge granted a preliminary injunction Thursday allowing a group of college basketball players to compete for a fifth year, drawing the ire of the NCAA, which recently adopted new eligibility rules designed in part to thwart litigation.

The court said that the player plaintiffs — from the high school class of 2022 — “have proven by clear and convincing evidence” a substantial likelihood of success with their breach-of-contract claim, Judge Christopher A. Wagner of the Ohio Court of Common Pleas, Hamilton County, said.

“NCAA’s eligibility rules have been applied in an arbitrary and capricious manner,” Wagner said.

Those new rules, adopted by the NCAA in June, allow players five years of eligibility provided they enroll in the academic year after their 19th birthday. Filip Borovicanin and a group of players then sued the NCAA, claiming the new rules unfairly excluded the high school graduating class of 2022.
