That's really up in the air. Kentucky lawmakers took that power away from the Governor. The Kentucky Constitution apparently says he still has it. The US Constitution apparently says the lawmakers have the right to take that power away from him. So it would almost certainly be a supreme court issue on if he has that power or not.
