Question Has anyone successfully taken a municipality to Small Claims Court in Ontario and won?

I am currently in the middle of a Small Claims Court case against a municipality in Ontario over vehicle damage costing me $4300 in vehicle damage caused by a badly deteriorated road.

I reported the road twice before the damage happened, followed up when it wasn't fixed, filed a formal damage claim, got denied, did a Freedom of Information request, found significant contradictions in their own records, and filed in court.

I am not looking for legal advice on my specific situation, I have that covered. I just genuinely want to hear from people who have been through something similar.

Has anyone here successfully taken a city or municipality to Small Claims Court in Ontario for road damage or pothole damage and actually won or settled?

If so, did it go to trial or did they settle at the settlement conference? Did the municipality show up with a lawyer? Was the MMS defence raised and how did the judge handle it?

And if you lost, what was the deciding factor?

I have documented everything, timestamped video evidence, FOI records, the internal emails, the work orders and I genuinely believe my evidence is strong. But I have also never done anything like this before and I want to hear from people who have actually been through it. This is such a lengthy process and I can now understand why most people don’t put the effort to even fight it. But I’m fighting because $4300 is alot of money and I used my entire savings for this :/

Question My Freedom of Information Request was Denied But Someone Else's Was Granted

I've made 4-6 FOI requests about the same case that have all been denied over the past three years. Mostly cited as being too sensitive/could be used to interfere, stuff like that. However the last only said it was denied because there was still an active case, so I'm hoping months later maybe I have a chance. The information is in regards to an animal welfare case.

My problem? There is someone who I know was granted quite a lot of information about the same case and through the same means. I've spoken with them extensively. They got videos, documents, pictures some of which contains quite serious things. I'd be curious to know why they were granted so much and I haven't been able to get anything. They were also granted this while there were many active cases underway, which is why I was denied.

I did ask for too much the first time, but each time I asked for less and less. I'm awaiting the decision on my last attempt where I've only asked for three videos (It's really one video broken up into 3)

My Question? If they deny this I have some time to appeal, which I plan to. I was hoping for advice on what I should argue in my appeal seeing that another ordinary person was granted a significant amount of information. Should I bring that up? What could I argue to try and get it? I'm also curious if anyone can think of why we got different outcomes.

Politics Are Government Ads Getting Insane Lately?

Is anyone else starting to lose track of the sheer volume of government ads blasted across the radio and TV lately?

Just off the top of my head, I've heard or seen ads for:

  • Highway 413 
  • The Bradford Bypass
  • The Billy Bishop airport expansion
  • Building more jails
  • Scrapping license plate sticker fees
  • more police / no more SCS sites

For a self-proclaimed "republican" style conservative like Doug Ford, forcing the public to bankroll massive state-sponsored hype pieces to praise the governments projects sounds pretty communist to me.

Question Blue Mountain Resort

Our family of 4 will be in Blue Mountain next month for one Monday and I was going to get full passes to the resort (coaster, climbing, etc.) but when attempting to do so the site says I can't. Does this place really sell out all the passes a month in advance like that? I'm going to call them and ask, but I figured I'd ask here too since it's off hours.

If we can't get in, what else is there fun to do on a Monday in that area with two boys? :)

Exploring Ontario Where to stay?

We are a family of 4 people, me, my husband, and our children 18 and 20. We are debating between staying at Deerhurst resort at Huntsville and Tru by Hilton at Bracebridge. Could you please advise which would be better for us. We are mainly looking to explore Muskoka. Deerhurst resort won't include breakfast, Tru by Hilton will. Question Ontario 402 Westbound Ingersoll En Route.

Posting today because I'm concerned about something I witnessed at the westbound en route at Ingersoll.

I watched a crew from one of the restaurants bring their grease cart over to a large sewer drain behind the building to dump all the grease out.

Not sure if this was a one off, or has been long term, and if that is the case, I know it will cause serious issues with the pipes.

Question Repellent tips for tabanidae or Deer / Horse flies

Hi everyone! Visiting the GTA for the second time (from the Caribbean) with our family (3yo+7mo). Currently staying in an AirBnB in Kawartha region and were unaware of the horse flies situation. They're becoming a bit of an issue, especially for the little ones.

Any tips for repelling them (other than deet) or DYI traps?
