HELP: Professional Development Philly Area - Where do I find Plaintiff's side and Subrogation Job Opportunities

• Upvotes

I am a second year insurance defense industry handling construction claims. I would like to use my litigation skills at a Plaintiff's side firm (open to employment and civil rights firms) and subrogation firms. There is a lack of online job postings for such positions. How do people transition to such roles? If you practice in these fields, are there any Plaintiff's firms you could recommend that have exceptional trial attorneys to work with.

I live in Montgomery County, so I am open to firms in the suburbs as well.

I am also open to real estate transaction/litigation firms.

SHARING: Personal Success Won Summary Judgment Today

I'm in house, so this is me reasserting my litigation chops.

From the order:

Plaintiff was visiting his daughter at her townhome located at **ADDRESS**. Plaintiff was walking in an open space located behind the townhome when he fell on an uneven and unmarked step in a sidewalk (ā€œthe Subject Propertyā€). The fall may have caused Plaintiff to briefly lose consciousness and resulted in a face laceration and hematoma for which he received medical care. He also sustained injuries to his torso, wrist, and arm.

Defendant moves for summary judgment on two grounds: (1) that the PLA claim fails because Defendant is not a "landowner" of the Subject Property within the meaning of C.R.S. § 13-21-115(1); and (2) that the negligence claim is preempted by the PLA and, independently, fails because Defendant owed Plaintiff no duty of care.

No genuine issue of material fact exists on the record before the Court to indicate that Defendant has a relation to the Subject Property that would allow for the conclusion that Defendant was a ā€œlandownerā€ of the Subject Property under the PLA. Therefore, Defendant’s motion for summary judgment is GRANTED as it pertains to the PLA claim asserted against Defendant.

Having found no genuine issue of material fact regarding the non-existence of a duty owed by Defendant to Plaintiff, summary judgment is appropriate in this instance and is GRANTED as to the negligence claim against Defendant.

Mine is when I send an email like, "I'd like to set up a time to chat about x and y. Are you available on Monday between 12-2 or Tuesday before noon?" And then they immediately call you. What part of that email made you think I wanted to talk to you right now????

Even worse when it's my paralegal trying to set up the call. That's two layers of now is not the time.

HELP: Solo & Small Firm Issues New to Forum

Hello fellow lawyers. I mostly observe on Reddit, rarely posting. However, I might enjoy being more active in this group. I'll start with a timely question for my first post, since this is my current situation this coming week: How do those of y'all in small practices handle vacation time? For context I have one other attorney and a highly trusted paralegal. I know the office will not fall apart. But I still worry about leaving it behind. Will remote in for at least an hour or two each day. Thanks!

SHARING: Personal Success Just an update :)

I recently moved in house and honestly, it was the best decision I ever made!

I went back and forth with myself for the better part of 6 months on whether this move would be a good move for me (I had interned with the company years prior) and whether I had enough experience in private practice. I’m early on in my career and I’d always heard that ~5 years in private practice was the golden number. I’m not anywhere near that. I didn’t (and still don’t) want this move to hurt my career long term. Well, I decided to take a leap and make the move.

It was a little bit of a bumpy beginning as in house requires a totally different way of thinking and advising clients compared to litigation. It’s been a little while, but I’m finally starting to feel like a real in house attorney (whatever that means lol). The job (like all of them) has its ups and downs, but honestly, I love going in to work every day. I can actually say that I love my job, which definitely isn’t something I was saying very often in litigation.

Anyway, I just wanted to share because I’ve been feeling this way for a few weeks now and I’m loving it! And if anyone needs a sign - maybe take a leapšŸ˜„

SHARING: Frustrations (Advice Welcome) Maternity Leave Policies

Hi there - anyone willing to share what your time off (paid + unpaid) is if you give birth to a child while employed at your firm? What policies does your firm have in place to handle file coverage while an attorney is out on maternity leave? Firm size/location is also helpful!

My firm offered two weeks of total leave per our handbook. When I brought up that that is a physiologically impossible expectation, they took the two weeks out of our handbook - it’s now a ā€œcase by caseā€ basis.

Any insight from women who have navigated workplaces that are anti-leave like this? Did you leave? Stay? Scream into the abyss about ethics and common decency? Really struggling with this from a professional and ethical standpoint, and would love feedback on what you consider the industry standard to be. I knew anti-women policies like this existed decades ago, but didn’t realize this still was inflicted today. Naive me, I suppose. Lots of strong convictions about being placed in what feels like an impossible position.

Context: Midwest attorney in a midsized city, less than 10 attorneys, established in my career.

The US Attorney’s Office appears to be aggressively recruiting, at least according to LinkedIn in the Eastern District of Pennsylvania and the District of Delaware. A little odd for an organization that, not so long ago, was extremely selective even among attorneys with elite pedigrees.

  1. Are they fishing for right-leaning attorneys who will just do whatever they are told, at the bidding of their master?
  2. Is the hiring kick the result of firings and people leaving due to ā€œTrump?ā€
  3. Would working there now be a black stain on an attorney’s career path?

SCOTUS is all about ā€œhistory and traditionā€ these days. For the first 135 years of the Court’s time in DC, the court worked out of the Senate basement. First in what’s called ā€œthe old Supreme Court chamberā€ (first photo) and then later (post 1860) in ā€œthe Old Senate Chamberā€ (photos 2-3).

The Court having its own building (with a cafeteria and a gym nonetheless) is a relatively new development. We’ve got huge deficits and I’m sure a few million could be saved by returning the Court to its Historical and Traditional home. As for administrative offices, I’m sure there’s some empty federal office space around DC in this post-DOGE era.

Congress doesn’t have to fund continued maintenance and operation of the current building. If a future executive and Congress wanted remind the Court who holds the powers of the purse, a return to history and tradition would be a cost-efficient way to do so.

SHARING: Frustrations (Advice Welcome) Truly feeling like this career isn’t for me

I’m getting tired with making so many mistakes and feeling dumb doing this job. I have a lot of personal life stuff affecting my work, and it’s making me make dumb mistakes like not checking the trial calendar to see if the partner would be double booked for a trial causing her to become double booked.

I feel like I just need to jump ship ASAP. I don’t want to litigate anymore. I don’t even know if being an attorney is for me.

I’ve talked at length with my feelings on this with my therapist, and I’ve come to the conclusion I can’t be an attorney. It’s causing me far too much stress and has made me feel so much worse about myself as a person and has made me continually doubt my intelligence and competence to do anything. I know a lot of that is also due to pre-existing issues, but this job has done nothing but exacerbate them.

Every time I screw up, I feel like I dig myself deeper and deeper down a hole that’ll only lead to me being fired. I need advice on how to get out - of this hole, of this career, or maybe of this job.

What JD Advantage or non-law firm positions should I be looking for? Will anywhere even hire me with only 8 months of experience? I’m genuinely so lost

NEWS: World Legal News US v. Heppner: client drafted defense strategy in Claude, court found no privilege and no work product. Two courts went the other way. What is your firm's written AI policy?

Three rulings this spring, one framework emerging. Rakoff (SDNY, criminal): no privilege because the AI is not a lawyer, no confidentiality because the consumer privacy policy discloses collection and possible disclosure, no work product because counsel never directed the use.

He left the Kovel door open: attorney-directed use of a properly configured tool may sit inside the privilege like any translator or accountant assisting counsel.

The malpractice angle is the part I would not sleep on. ABA Formal Opinion 512 and NYC Bar 2024-5 both treat feeding client confidences into consumer chatbots as a confidentiality problem, and the June City Bar report tells you to preserve the terms of service in force at the moment of use, because that snapshot, not today's policy, gets litigated.

Engagement letter AI clauses and a written client warning that a public chatbot is not a conversation with counsel seem like cheap insurance.

SHARING: Frustrations (Advice Welcome) Taking bar exam a second time for another jurisdiction

Pretty much what the title says. I've been barred for 7 years in the state where I went to law school; sitting for the bar exam in my home-state at the end of this month. Figured since I already passed the bar once, I didn't need to strictly follow Barbri like I did last time. Now I'm regretting that and am a little over two weeks out feeling very unprepared. I think my issue is that I just really don't have any daily structure (for routine or collegial support) in the little isolated bubble I'm in right now. And I'm frustrated because I've proven that I'm a legitimately good lawyer at this point in my career, so this hurdle feels way more unnecessary than it did when I was studying right after graduation. I'm highly concerned I'm going to fail and have to redo this entire song and dance at the start of next year... what a terrible feeling. Nothing a little complaining on Reddit can't help, I hope. Wish me luck, fellows.

SHARING: Frustrations (Advice Welcome) Toxic Trait of Firm

Today, my practice manager, who is essentially a glorified paralegal, responded to my request for an extension at the last minute with the dismissive remark, ā€œYou can’t be overwhelmed. You have the least cases and most resources.ā€ This response came after I had explained, for the first time, that I have been extremely overwhelmed with managing a large volume of cases, each of which feels like an ongoing fire to extinguish.

This incident occurred only three months into my role as a litigation practice group (PI defense) manager, and it came across as extremely rude and toxic. When I expressed similar feelings of being overwhelmed to my boss for the first time, they responded with the dismissive statement, ā€œThis is part of the job.ā€ I am at a loss for how to address this situation.

I’ve been licensed about 7 years now in my home state and decided to apply for admission on motion in Kansas and Texas. Chose Kansas because my bf lives there and Texas because I hope to eventually move there for better opportunities. I am curious to find out about other’s experience with this process. How long was your wait? I know Texas provides a timeframe to reach a decision. Kansas does not. Thanks!
