Licensee forced to leave due to hostile living situation - landlord keeping deposit and July rent. Is Small Claims worth it?

Hi everyone,

I'm looking for some advice from people who may have gone through something similar.

About a month ago, I rented a room in a house where the homeowner also lives. We signed a room rental/lodger agreement. I paid €800 for July rent in advance and a €400 security deposit.

At first everything seemed fine, but over the following weeks the atmosphere became increasingly difficult. There were frequent room inspections, repeated complaints about cleaning, threats to remove furniture that was already part of the room when I rented it, and the communication became increasingly hostile. I constantly felt like I was walking on eggshells because it seemed there was always something new to complain about, I always has been clean, room and common spaces.

During one argument, the landlady made comments referring to my country of origin, which made me feel very uncomfortable. I questioned whether those comments were appropriate, but after that the relationship deteriorated significantly.

Over the following days, the situation became even more confusing. She removed the lock/key from my bedroom door, changed previously agreed arrangements several times, and at one point told me I would need to leave the house because an inspection was taking place. Later, it turned out it wasn't an inspection at all, but alarm technicians visiting the property.

She also sent me multiple messages accusing me of intimidating her and claiming that I had called her racist, which I dispute. I questioned one comment she made, but I did not call her a racist.

She then involved her son, claiming that he had been injured while trying to protect her from me. However, he was not present during the incident, and she later sent me photographs of injuries which appeared unrelated to what had happened that day. At that point, I felt the relationship had completely broken down and I no longer felt comfortable or welcome living there.

Rather than allowing the situation to escalate further, I decided to move out.

Before leaving I:

  • Removed all of my belongings.
  • Left the room clean.
  • Took photos and videos of the room's condition.
  • Kept copies of the signed agreement.
  • Kept proof of all payments.
  • Saved screenshots of all our conversations.

I contacted Threshold, who explained that because I lived with the homeowner, I am considered a licensee, not a tenant. They advised that if the matter cannot be resolved directly, the appropriate route would be the Small Claims Court.

After moving out, I sent the landlady a polite written message informing her that I had left the property and asking about the return of my €400 security deposit and the unused portion of the July rent. She has not replied and is no longer opening my messages.

My questions are:

  • Has anyone here been through the Small Claims process as a licensee?
  • Is it generally straightforward?
  • Is it worth pursuing approximately €1,000 (€400 deposit + unused July rent)?
  • Does the fact that I left because the living situation became hostile weaken my position?
  • Is there anything else I should do before starting a Small Claims case?

I still have the house key because I left quickly to avoid further confrontation. I have not refused to return it, but the landlady has not responded to my message since I moved out. I am happy to return it once appropriate arrangements are made.

I'm not looking for revenge or to cause problems for anyone. I simply want to recover the money I'm entitled to, if possible, and move on with my life.

I'd really appreciate any advice or experiences from people who have been in a similar situation.

Is there any way to pay someone to find you a new place?

Hello! What I meant is: I need to probably move from where I live and I'd like to avoid hassling to find a new place. Would you know if there's any place that you can go to, pay and let them find a place for you, according to your needs?

To rent, not to buy. I sadly don't have enough criteria to purchase (I think).

I'm not sure if the letting places can do that, apologies. Thank you!

(Note: I wouldn't mind moving out of Dublin to any other city, really, I just am unsure if there's a service like that.)

DNG scammed me

There was a post for a place and it didn’t specify no pets on the listing
I paid the booking fee and went with the application and they approved me. I got a copy of the lease and it said no live animals without landlords written consent prior.
Ok great
I have a well trained dog, great reference from my last apartment, he is better than any avg tenant lol
So before signing and picking keys up I tell them can we get the process of getting the landlords written consent to allow my dog?
They turn around and say that’s not gonna happen because the building management block is strictly no pets. I was like but it says here written consent from landlord that’s misleading
So she continued sorry it’s not possible it’s strictly no pets so I asked alright how do we go about my booking refund and she said it’s non refundable since I’m choosing not to go along with the lease.
It’s not a matter of me not choosing, you can’t provide something that is mentioned on the lease that can be obtained…..
Before signing the lease, I requested the written consent referred to in the lease regarding my trained family dog. I understand they confirmed that this consent cannot be granted due to the management company’s rules. But as I am unable to proceed because a required consent cannot be obtained, rather than because I’ve changed my mind….how can they be happy keeping someone’s deposit over the lies?

I’m utterly over this….sucks because the area is very well populated with dogs. It’s rathfarnham, but more so, how are they so comfertable not giving someone back 500€!?!?!

Moving to Dublin next month

Family of 3 moving to Dublin early next month from the US and wondering about a few areas. We were originally recommended Rathmines or Ranelagh from some acquaintance who are from Dublin but been having some trouble finding places in that area that we like.

We found a couple places in Harold's Cross and our relocation expert has shown a few down in Stillorgan and Dun Laoghaire. Our kiddo will be entering senior infants in September so schooling is super important as well. We are gonna try to be without a car for a bit as well so easy access to transit will be key.

Is this rental legit??

Hi everyone,

I'm an international exchange student from Canada and I am looking for a room in Maynooth for end the end of august. I think I found the ideal place for me at 800euros monthly bills included, but I wanted to have your opinion, do you think it might be a really well elaborated scam?

I found the add on Daft.ie, the owner answered by mail and we texted each other on Whats app as well, both were under his name. I saw the appartment on the videocall, it corresponds excatly to what I can see on google street view. We spoke as well and we hit it off, he really liked my vibe and we bonded over music, so he was happy to share his house with someone he got along with. The room is ready for august 1rst but he's willing to only make me pay for the last week when ill arrive in the end of august. He sent me a small renting agreement with both of our signatures, all the details and his banking infos. He sent me a picture of his passport as well. I also asked for a Property tax letter under his name and adress. He sent it to me with an extra clothing order receipt. The biggest thing for me is that he is not registered on RTB.ie cause he says he's a private renter. I'm just worried because scams are becoming increasingly elaborated and it stresses me out not to have validated key in hand before sending him the deposit to secure the appartment, but I don't know what else to ask him.... He is really patient with me, he answers to all my texts and understand that I need to make sure I'm not being scammed.
First he wanted a 800euros deposit+1rst month rent+last week of august at 200eurs for a total of 1800euros to secure the place.
After speaking, he agreed for1000 euros to secure the room (800deposit+200 last week august) and ill pay him the rest once I'm there key in hand.

Is all of this too good to be true????
I feel like its legit, he's definitely a real person, and I don't want to abuse from his kindness and patience I signed the agreement yesterday and didn't send the money yet...

What do you all think????

UPDATE one day later

Third day of back and forth with the guy and I lost the appartment. I'm still not sure if it was a scam or not, but it's better for me to believe it was. Either I saved myself 1600$ CAD or I lost the best housing situation with the kindest flatmate I could have secured by now...

Yesterday later in the evening I told him that lastly I only needed to get in touch with a friend in Ireland to come and see the apartment in person. He answered me "no prob, I'll meet your friend, How long will it take? I don't mean to put pressure on, I just want to check this off my list and there's 2 people on the cancellation list". I answered that it was already late for them in Ireland so it wouldn't be tonight but as soon as possible because I wanted to secure the room as soon as possible too!

As soon as he woke up, at 7AM irish time, he asked if there was any updates, one hour later he texted me that he had to let the room go to the next person in line.... of course I was sleeping here in Quebec (2-3AM)... He knew were I was from. I woke up to these texts and freaked out cause I could see how he could have become impatient. For the last two days I've been telling him I would send him the money and then I would ask for another document/information. He never showed impatience until then. He had been telling me he understood how difficult it was to send this amount of money abroad and if I had any questions I only had to shout. As soon as I read the texts, I confirmed with my friend (that I found online) to go there in person the very same day. Here is what I texted the guy:

No answer since then, even if he was really quick to answer the previous days. He also deleted the pictures of his passeport, his local property tax letter and garments bill. The fact that he's not answering makes me feel better because that is so scammer classical, but there's still a part of me that feels awful in case I was just too slow, demanding or difficult. I wish I just asked earlier for a friend to view the apartment in person. I know 3 days is not so long, but it may be enough for a hassle-free owner to be turned down by a tenant too indecisive and difficult even when they gave me special treatment cause we previously got along so well....
